Abstract

Indonesia guarantees freedom of religion and belief for adherents of local religions by Pancasila and the 1945 Constitution. Although their rights are recognized in the constitution and reinforced by Constitutional Court Decision No. 97/PUU-XIV/2016, there are still various obstacles faced, especially in the fields of administration, education, and civil rights. Moreover, the implementation of public policies related to this issue also faces many obstacles. Therefore, concrete steps are needed to trace the values recognized in the Indonesian constitution, so that adherents of local religions can continue to exist within the framework of citizenship despite various challenges. This research aims to analyze the values of adherents of local religions in the context of the Indonesian constitution using the theory of religious freedom. The research method is a literature study, with a descriptive qualitative analysis approach. By collecting and analyzing data such as books, journals, articles, manuscripts, news, and state documents relevant to this research. The results of this study explain that Adherents of local religion have a constitutional position guaranteed by the 1945 Constitution, especially in terms of freedom of religion and belief. The Constitutional Court Decision Number 97/PUU-XIV/2016 and its various derivative regulations have strengthened the recognition of their civil rights, including the inclusion of belief identities in population documents, access to education, and public services. In addition, Adherents of local religion play a role in preserving spiritual values, human rights, and local wisdom that align with the principles of Pancasila. Although still facing implementation challenges and bureaucratic resistance, the government continues to strive to ensure the rights of citizens for Adherents of local religion in national and state life. This research has some limitations, therefore it is necessary to conduct further studies on the values contained in Penghayat Kepercayaan and its integration into the state legal system. This step will help to understand more deeply the reasons and consequences of the presence of the belief system in the context of the Constitution more comprehensively.
