AN ANALYSIS OF SHARIA COMPLIANCE IMPLEMENTATION IN ONLINE STORE OPERATIONS (A CASE STUDY AT NIBRAS HOUSE SECANG)
Abstract
The growth of online commerce in Indonesia has accelerated rapidly, with
an average annual rate of 53.23%; however, this expansion is often not matched
by comprehensive Sharia compliance. Nibras House Secang, operating as a hybrid
store (manufacturer and agent), serves as the case study due to operational
characteristics that indicate compliance gaps, such as the omission of displayed
prices, the absence of customer review features, and the lack of written SOPs.
This study aims to analyze the online business management system at Nibras
House Secang and evaluate its compliance with Sharia principles based on Fatwa
DSN-MUI No. 146/DSN-MUI/XII/2021. This research employs a qualitative
method with a descriptive-analytical approach. Data were collected through indepth observation, interviews, and documentation. The results reveal two primary
findings. First, regarding business management, the store demonstrates adaptive
management with effective digital marketing strategies and a robust hybrid model,
yet it remains weak in formal governance (lack of written SOPs) and heavily
relies on manual communication. Second, regarding Sharia compliance, the store's
operations do not fully meet the Fatwa provisions. While the contract (sighat) and
product descriptions are compliant, significant violations were found in
transparency aspects (the absence of displayed prices and public review features
for operational efficiency), as well as return policies that limit khiyar rights
contrary to fiqh principles. This study recommends the formalization of SOPs and
the enhancement of digital transparency features to realize accountable and
Sharia-compliant business governance.
